Establishing Negligence in Burn Injury Cases

A burn injury can occur when your body’s tissues come into contact with a heat, chemicals, sunlight, radiation, or electricity. Some of the most common causes of burn injuries involve hot liquids, steam, flammable liquids and gases, and building fires. Burn injuries can also occur due to excess inhalation of smoke. In addition, burn injuries frequently occur in cases involving defective products. Burn injuries are divided into three categories based on severity of injury. First-degree burns cause injuries to the outer layers of the skin, while second-degree burns cause damage to the outer layer of skin and the layer underneath. The worst category of burns, third-degree, destroy or damage the deepest layer of skin and underlying tissues.

To recover compensation for your burn injury under the legal theory of negligence, you must show that the person who caused the burn acted carelessly. Negligence law applies to virtually every personal injury action, and requires the plaintiff to first establish that the defendant owed the plaintiff a duty of care and the that the defendant failed to meet that standard. The duty of care requires a defendant to use the same ordinary care and skill that a reasonable person would use in a similar situation. After establishing that the defendant breached the duty of care, the plaintiff must show that the defendant’s breach was the direct cause of the plaintiff’s injury. In other words, the plaintiff must show that the injury would not have occurred but for the defendant’s breach.

Compensation for Burn Injuries

Finally, the plaintiff must provide evidence of the damages that he or she has suffered as a result of the defendant’s breach. In a burn injury case, the victim often experiences painful wounds to the skin and body, which sometimes require hospitalization. Unfortunately, some burns leave scars and other signs of disfigurement. For some victims, plastic surgery cannot completely erase the visible reminders of the pain that they have suffered. As a result of these deep and lasting injuries, burn victims may recover compensation for a wide variety of damages including medical expenses, physical therapy, long-term care, loss of earning capacity, and lost wages. In some cases, the close family member of the victim may be able to seek damages for loss of consortium, which acknowledges the family member’s loss of their loved one’s support, companionship, and love as a result of the injury.
