Can I sue a Maryland Nursing Home for Injuries Received by My Elderly Mother?

Yes. If you suspect that an elderly or otherwise handicapped family member has been hurt, injured or abused by the staff or management of a nursing home or assisted living facility, you could have grounds for a Maryland personal injury lawsuit. Hundreds of thousands of older Americans receive care at nursing facilities all across the United States, yet sadly, many of these individuals are either intentionally mistreated by uncaring nursing home staff or receive poor or injurious medical care leading to serious health problems or even death.

In order to receive funding from Medicare and Medicaid, Maryland nursing homes are required by law to comply with the Code of Federal Regulations. In general, these regulations require nursing homes and their staff to provide each resident with the necessary care and services to “attain or maintain the highest practicable physical, mental, and psychosocial well-being.”

If the resident of a nursing home, or the family of someone residing at a Maryland nursing facility, suspects negligence in care or outright abuse by the nursing home staff or management, it is advisable to speak with a personal injury attorney to determine a course of legal action to stop the negligent treatment or abuse and then to seek restitution for any injuries sustained.

At Lebowitz & Mzhen, LLC, we understand how difficult it is to see a beloved parent or grandparent suffer the effects of declining health without having to deal with the heartbreak of a life-threatening medical error or the outright abuse of their loved one by a caregiver. There should be no tolerance for such behavior on the part of any nursing home or assisted living facility.

Federal regulations require Maryland nursing facilities to maintain a proper level of their residents’ quality of life. To do so, nursing homes and assisted living facilities must promote care for their residents “in a manner and in an environment that maintains or enhances each resident’s dignity and respect in full recognition of his or her individuality.” Allowing a resident’s bed linens or bath towels to become excessively dirty can be a warning sign that care is not being properly provided. Linens should be provided in good, safe and clean condition. As well, each resident should be provided with a comfortable and homelike environment that allows him or her to have the use of personal belongings to the best possible extent.

Sadly, these most simple of provisions are often overlooked in some nursing homes; and, at worst, the quality of care declines to a point that makes everyday living not only uncomfortable, but physically dangerous or impossible. If you suspect that a loved one is receiving improper or sub-par care at a Maryland nursing home or assisted living residence, we urge you to contact a qualified legal professional who has experience in nursing home negligence cases. There is no reason why your loved one must suffer day-in and day-out at the hands of an uncaring organization, much less have them be exposed one more day to possible injury or death.

If you believe that a Maryland nursing facility has been negligent in its treatment of your family member, please take the time to contact a skilled nursing home abuse attorney. The professional legal team at Lebowitz & Mzhen, LLC, is ready, willing and able to provide help and assistance in filing a personal injury claim against a negligent assisted living facility, doctor or nursing home staff member.
