Seeking Compensation through a Negligence Claim

To recover damages after an accident, a victim usually tries to establish that the defendant acted negligently. Negligence has four elements: duty, breach, causation, and damages. The first element, duty, requires the victim to show that the defendant owed him or her a duty of care. In general, the duty of care requires each person to act with the same ordinary care and skill that a reasonable person would use in the same or similar circumstances.

In some cases, the duty of care is informed by the context in which the accident occurs. For example, in a car, truck, or motorcycle accident, the duty of care examines whether the defendant operated his or her motor vehicle in the same way that a reasonable driver would under the same roadway and weather conditions. The second element of negligence requires the plaintiff to show that the defendant’s conduct failed to meet the duty of care, resulting in a breach.

Third, the plaintiff must show that the defendant’s breach was the direct cause of his or her injuries. Causation requires the victim to prove that he or she would not have been hurt if the defendant had met the appropriate standard of care. In the context of a medical malpractice case, for example, common causation issues involve the failure to diagnose an injury, improper diagnosis, and medication errors.

The last element of negligence requires a victim to provide evidence of his or her damages. Examples of categories of compensation available to many injured individuals include medical expenses, physical therapy, lost wages, loss of future earning capacity, and pain and suffering.

Unfortunately, some accidents are so severe that they result in someone’s death. If a loved one has lost his or her life as a result of someone else’s carelessness or recklessness, you may be able to bring a wrongful death claim to recover damages for the loss of your family member’s support, companionship, and love.
